Auction Terms and Conditions

THIS IS NOT AN ABSOLUTE AUCTION. All sales are subject to Seller confirmation and approval. The Seller reserves the right to decline any bid.

• Account Requirement: You must create a valid user account on our Shopify store and be logged in to place a bid.
• Accurate Information: You agree to provide accurate, current, and complete contact and payment information.
• Age Limit: You must be at least 18 years old and legally capable of entering into binding contracts.

• Bids are Binding: Every bid placed is a legally binding contractual offer to purchase the item. You cannot retract or cancel a bid once it is submitted.
• Popcorn Bidding Policy: To prevent "bid sniping," any bid placed within the final 2 minutes of an auction will automatically extend the bidding window for an additional 2 minutes until all active bidding stops.
• Platform Limitations: The Company is not responsible for technical glitches, internet delays, or Shopify app failures that result in missed bids. The official server time of our Shopify app dictates the close of all auctions.

• Winning Bid: The highest bid recorded at the close of the auction is the winning bid (the "Hammer Price").
• No Buyer’s Premium: No buyer’s premium will be charged. The winning bidder will pay only the Hammer Price, subject to any applicable taxes, duties, or fees required by the buyer’s state or jurisdiction.
• Taxes: Pickup is located in Delaware. Delaware has no state sales tax. Shopify will not charge tax at checkout. However, buyers are responsible for any applicable taxes, duties, or fees required by their own state or jurisdiction.

• Payment: All items must be paid for within 24 hours of receiving notification of a winning bid via email. If payment fails and is not resolved within 24 hours, the Company reserves the right to cancel the sale and offer the item to the next highest bidder. No transfer of items will be recognized between buyers.

• No Guarantees: All items are sold "AS-IS, WHERE-IS" with all faults. The Company makes no warranties, express or implied, regarding the condition, authenticity, or fitness for a particular purpose of any item. Descriptions and photos are for informational purposes only. All sales are final. No returns, refunds, or exchanges will be issued.
• Safety and Assumption of Risk: The buyer acknowledges that items sold—specifically ride vehicles, motorized units, animated props, and structural set pieces—were manufactured or modified for closed-circuit amusement park/haunted house operations. They may not comply with standard residential safety codes, consumer product regulations, or electrical standards. By bidding, the buyer assumes all risk of injury, property damage, or death resulting from the transport, installation, display, or operation of the items. The Company holds zero liability once the item leaves our premises.
• Hold Harmless & Indemnification: The buyer hereby indemnifies and holds harmless The Funland Store, Seaside Amusements, Inc, Fasnacht Realty, Inc., and their owners, officers, employees, and agents from any and all damages, claims, or liabilities arising from any injuries to persons or property of any type whatsoever caused during the sale, on the premises, or during the removal of purchased items. The buyer assumes all risk upon taking possession of purchased items.
• Specialized Equipment Disclaimer: Many props contain pneumatic cylinders, specialized lighting, animatronics, or custom wiring. The Company does not guarantee that these components operate safely, correctly, or at all. All items are sold purely as decorative memorabilia. Any attempt by the buyer to wire, plug in, or mechanize these items is done entirely at their own risk.
• Intellectual Property: The sale of a physical prop or ride car does not transfer any intellectual property rights, trademarks, character copyrights, or branding privileges to the buyer. The buyer agrees not to use the purchased items to replicate, market, or operate a competing commercial attraction using the Company's name, themes, or specific storylines.

• No Shipping Available: All items—including ride cars, structural doors, and props—are sold for local pickup only at our designated venue in 6 Delaware Ave, Rehoboth Beach DE 19971. The Company will not pack, palletize, crate, or ship any items under any circumstances.
• Buyer Demolition & Loading Liability: The buyer is solely responsible for providing all labor, tools, dollies, tie-downs, and appropriate vehicles (e.g., flatbed trailers, box trucks) required to safely dismantle, remove, and load their purchases. Company staff will not assist with lifting, loading, or securing items.
• Curbside Removal Only — No Forklift on Property: All removal is curbside only. There is no forklift or mechanical lifting equipment available on the property. Buyers are solely responsible for bringing any equipment necessary to safely load large or heavy items, including but not limited to ride vehicles, structural set pieces, and animatronic props.
• Property Damage: The buyer faces strict liability for any damage caused to the Company's premises, building, or utilities during the removal of their items.
• Strict Pickup Window: All items must be removed during designated pickup hours (10:00am–4:00pm) between October 16th, 2026 and October 19th, 2026. Specific pickup hours for each item are listed in the individual item description.
• Abandonment & Storage Fees: Any item not picked up by the final deadline will be considered legally abandoned, regardless of whether it has been paid for in full. The Company reserves the right to retain the payment, revoke the buyer's ownership, resell or dispose of the item.

• Pre-Bidding Changes: Prior to the start of the bidding period, the Seller reserves the right to add, adjust, withdraw, or re-lot any items without notice.
• Post-Bidding Changes: Once the bidding period has begun, any additions, deletions, or material changes to auction lots will be announced on our Auction Announcements page. Bidders are responsible for reviewing announcements before placing bids.
• Order of Sale: Any listed or announced order of sale may be changed at the Seller's discretion.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms, the auction, or the purchase of items shall first be attempted to be resolved informally by contacting us directly. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in Delaware.
